GSP™ Course Terms & Conditions

By enrolling in the Group Soundbath Player™ (GSP™) Certification Course offered by Beyond Percussion, you agree to be legally bound by the following Terms and Conditions. Your agreement is confirmed by checking the box on the course registration form before submitting payment, which serves as your electronic signature, equivalent to a handwritten signature under applicable law.

Related Agreements. The parties acknowledge that additional agreements, including a GSP Course Confidentiality and Non-Disclosure Agreement, and a Certified Soundbath Player License Agreement, will be executed as part of this relationship. All such agreements are intended to operate together and shall be read collectively to reflect the full understanding of the parties.

0. Definitions

Participant/Registrant: The terms “participant” and “registrant” are used interchangeably and refer to the individual who enrolls in the GSP™ Certification Course, meets the eligibility requirements outlined in Section 10, and agrees to these Terms and Conditions. Only the individual who registers may participate in the course.

Course Start Date: The date payment is made for the course, marking the beginning of the 365-day access period.

Course End Date: The date 365 days from the Course Start Date, or the extended date if a six-month extension is approved, by which all course requirements must be completed.

Course Workbook: The official guide provided by Beyond Percussion, containing instructions and requirements for completing Technique Practice, Practice Events, and other course assignments.

SoundbathPlayer™ Study Hub / Account Dashboard: The online platforms provided by Beyond Percussion for accessing course content, submitting assignments, and managing course progress.

Good Standing: A status indicating the participant has no outstanding violations of Beyond Percussion’s agreements, policies, or financial obligations with Beyond Percussion or its subsidiaries.

Certified Soundbath Player License Agreement: This is a mandatory legal agreement that participants must sign before receiving certification. It governs the use of Beyond Percussion’s intellectual property. It prohibits the teaching of how to play sound baths and how to play a gong or crystal singing bowl for use in sound baths, sound therapy, sound healing, or any other sound-based practices for 18 months following certification. Confidential information and techniques may never be shared.

1. GSP Course Confidentiality and Non-Disclosure Agreement

The GSP™ Certification Course provides proprietary training for conducting group sound bath events. Participants must sign a GSP Course Confidentiality and Non-Disclosure Agreement immediately after payment to access materials. Unauthorized sharing, reproduction, or teaching of course content is strictly prohibited and may result in expulsion, certification revocation, and legal action.

2. Prohibition on Teaching and Competing Activities During Enrollment

Participants are strictly prohibited from teaching, mentoring, or coaching others on how to play gongs, crystal singing bowls, sound baths, or similar sound-based practices, or from promoting any competing sound bath (or similar) training programs, including holding sound-related courses at a venue they own, while enrolled as an active student in the GSP™ Certification Course.

Participants are also prohibited, directly or indirectly (including as an employee, consultant, partner, or contractor), from the retail, distribution, or manufacturing of gongs, crystal singing bowls, or other sound bath instruments while enrolled as an active student. This prohibition spans the entire one-year (365-day) period of course access from the Course Start Date and any approved extension period (per Section 11). Violation of this prohibition will result in immediate expulsion from the course without refund, revocation of any progress toward certification, and potential legal action.

3. Liability Waiver

Participants acknowledge that participation in the GSP™ Certification Course, including the use of sound bath equipment (e.g., gongs, crystal singing bowls), may involve risks such as psychological discomfort, hearing issues, or equipment-related damage. By enrolling, participants waive and release Beyond Percussion, its affiliates, and instructors from any liability for claims, damages, or injuries arising from course participation, equipment use, or application of learned techniques, to the fullest extent permitted by law. Participants assume full responsibility for ensuring their physical and mental suitability for the course and for using equipment safely.

Instruments Purchased from Beyond Percussion: Beyond Percussion is not liable for any issues related to instruments purchased from Beyond Percussion or its subsidiaries, including but not limited to defects, damage during shipping, or improper use. Participants assume all risks associated with the purchase, handling, and use of such instruments.

4. Code of Conduct

Participants must act respectfully and professionally in all course interactions, including online discussions and practice events. Prohibited behaviors include harassment, discrimination, or actions that disrupt the learning environment. Violations may result in expulsion without refund.

5. Payment and Fees

Full Payment: The full course cost, as listed on the registration page, is required at the time of registration.

Registration Fee: A $250 non-refundable registration fee is included in the total course cost.

Processing Fees: All credit card and transaction processing fees for any Beyond Percussion services (courses, workshops, events, or instrument purchases) are non-refundable.

International Participants: Payments must be made in U.S. dollars (USD). International participants will be charged an International Processing Fee, currently ranging from approximately $40 to $110 depending on the registration option selected, to cover the additional cost of collecting international payments. This fee, along with the applicable total, will be displayed before payment is submitted. International participants are also responsible for any VAT, GST, or similar taxes applicable in their jurisdiction, which will be calculated and collected by our payment processor at checkout. Beyond Percussion is not liable for exchange rate fluctuations or additional costs beyond what is disclosed at checkout.

6. Tax Compliance for International Participants

International participants must provide any tax-related documentation required by their jurisdiction to ensure compliance with local tax laws. Beyond Percussion is not responsible for verifying or ensuring compliance with international tax obligations.

7. Refunds and Cancellations

Grace Period: Participants may cancel enrollment and request a refund, less the $250 non-refundable registration fee and all processing fees, within five (5) calendar days from the date of payment, provided they have not accessed or been exposed to any course content available through the SoundbathPlayer™ Study Hub or Account Dashboard. Logging in to either platform constitutes access to course content and immediately terminates the Grace Period, rendering the payment non-refundable.

Refund Process: Refund requests must be submitted in writing to questions@soundbathplayer.com within the Grace Period. Approved refunds will be processed within ten (10) business days to the original payment method.

No Refunds Outside Grace Period: All sales are final after the Grace Period. No refunds or cancellations are permitted.

Non-Completion: No refunds will be provided for participants who do not start, complete, or finish the course after the Grace Period has expired, regardless of the reason.

8. Registration Requirements

Participants must register using their full legal name, verifiable by government-issued ID. Name changes require legal documentation verified by Beyond Percussion.

Only the individual who registered for the course may participate and access course content. Sharing access is prohibited and may result in expulsion.

Identity Verification: Beyond Percussion reserves the right to verify participant identity at any time during the course by requesting proof of identity such as a government-issued ID, selfie or other form of verification. Participants must provide the requested proof of identity within a reasonable time in order to maintain course access. Failure to comply may result in suspension or revocation of course access. Beyond Percussion will make multiple attempts at contact before revoking course access.

9. Course Eligibility

To enroll, participants must: be at least 18 years old; possess a valid government-issued ID; be in good standing with Beyond Percussion, along with its subsidiaries and associated companies; and be eligible for enrollment. Criteria rendering a participant ineligible are outlined below.

Ineligible Individuals or Entities:

  • Individuals who have taught or are currently teaching others in the use of crystal singing bowls or gongs in the context of sound baths, sound healing, sound therapy, or any similar sound-based practice, whether in-person or online.

  • Individuals or entities previously or currently engaged in retail, distribution, manufacturing, or promotion of gongs or crystal singing bowls.

  • Individuals providing coaching or mentoring students on how to play sound baths, gongs, or crystal singing bowls in a sound-based practice.

  • Individuals who have assisted or are currently assisting in a sound-based training or workshop with gongs and crystal singing bowls.

  • Individuals involved in any capacity in the development or delivery of a sound-based training program with gongs or crystal singing bowls.

  • Venue owners (public or private) who have hosted training or workshops in playing gongs, crystal singing bowls, sound baths, or similar sound-based practices at their space within the past two years.

  • Consequences of Ineligibility: Participants who enroll but are found to be ineligible, as determined through Beyond Percussion’s audit rights (per Section 16) or other verification processes, will have their course access terminated, be expelled from the course without refund, and have any certification revoked, as outlined in Section 15.

10. Course Access and Completion

Timing: The course is self-paced, typically requiring 2–6 months to complete.

Access Duration: Access is granted for 12 months (365 days) from the Course Start Date (date of payment).

Course End Date: All requirements, including the certification exam and Certified Soundbath Player License Agreement, must be completed by the Course End Date. No exceptions.

Extension: A six-month extension may be requested for a $400 fee via the Account Dashboard’s Get Help page before the Course End Date. No extensions are granted post-Course End Date. SoundbathPlayer Pro memberships are NOT included in a paid extension, but may be purchased separately by the year.

Complementary Extension: Students who purchase a Made-On-Request gong or a gong and crystal singing bowl package receive a free 6-month course extension. SoundbathPlayer Pro membership is included in this extension.

Certification Exam: A 50-question multiple-choice exam requires a 70% passing score. One retake is included; additional retakes may incur a fee.

11. Equipment Requirements

Participants must have:

  • a computer or tablet with internet access (desktop/laptop recommended), 

  • a smartphone with a scanning app (e.g., Adobe Scan) for submitting assignments, and 

  • a standalone decibel meter for accurate sound measurement.

  • Required Instruments: 

    • one 30 inches or larger gong (no wind gong, nickel silver or bronze recommended); 

    • one large gong mallet and two small or medium gong mallets; 

    • three crystal singing bowls (at least one in 3rd octave); and 

    • two crystal bowl mallets designed for rim and side playing.

12. Certification Requirements

To earn certification, participants must: 

  • complete all GSP™ Player Essentials lessons; 

  • complete 30 hours of Technique Practice per the Course Workbook; 

  • conduct 10 practice events per the Course Workbook; 

  • submit all assignments and attendee feedback forms; 

  • pass the Certification Exam (70% or higher); 

  • sign the Certified Soundbath Player License Agreement, and 

  • maintain good standing with Beyond Percussion. 

Certification may be revoked for violations of course agreements or intellectual property misuse.

13. Promotional Instrument Credit (Advantage Plan)

Non-Monetary: Credit has no cash value and cannot reduce course fees.

Eligibility: Non-transferable; only the registrant may use it for select Beyond Percussion instruments.

Restrictions: Cannot be applied to shipping, taxes, prior purchases, or combined with other promotions (except regular player or SoundbathPlayer™ Pro discounts).

Expiration: Expires 3 months from registration; no extensions.

Forfeiture: Violating course terms or canceling during the Grace Period forfeits the credit.

14. Right to Refuse Service or Revoke Certification

Beyond Percussion may refuse service, terminate participation, or revoke certification for: 

  • non-compliance with course agreements (GSP Course Confidentiality and Non-Disclosure Agreement, Terms and Conditions, Certified Soundbath Player License Agreement); 

  • dishonesty or falsifying registration or assignments; 

  • ineligibility under Section 10, including enrolling while ineligible; 

  • teaching or engaging in competing activities during enrollment (per Section 2); 

  • disruptive behavior or violations of the Code of Conduct (per Section 5);

  • unauthorized use or distribution of course materials; 

  • non-payment or filing payment chargebacks (for reasons other than legitimate fraud); 

  • illegal or unethical conduct, including violations of applicable laws; 

  • public disparagement or actions harming Beyond Percussion or its subsidiaries’ reputation; 

  • failure to comply with identity verification requests (per Section 9); or 

  • misuse of the course platform (per Section 17). 

Violations may result in expulsion without refund, certification revocation, and legal action.

15. Audit Rights

Beyond Percussion reserves the right to audit participant activities (e.g., social media, websites, or public events) to ensure compliance with these Terms and Conditions, the GSP Course Confidentiality and Non-Disclosure Agreement, and Certified Soundbath Player License Agreement, including the prohibition on teaching or competing activities during enrollment, after certification is achieved, and intellectual property restrictions. Non-compliance may result in expulsion, certification revocation, and legal action.

16. Course Platform Usage Restrictions

Participants may only use the course websites and applications (e.g., SoundbathPlayer™ Study Hub, Account Dashboard) for authorized purposes related to completing the GSP™ Certification Course, ordering instruments, communicating with Beyond Percussion, or accessing content contained in SSL™ Skill Building or SoundbathPlayer™ Pro memberships. Prohibited activities include, but are not limited to, hacking, scraping content, reverse-engineering, or overloading the platform. Violations may result in immediate suspension or termination of access without refund, certification revocation, and legal action.

17. Intellectual Property and Confidentiality

Course Materials: All content is the exclusive property of Beyond Percussion. Unauthorized use, reproduction, or distribution is prohibited and may result in expulsion and legal action.

Trademarks and Copyrights: Unauthorized use of Beyond Percussion’s intellectual property is prohibited.

Confidentiality: Participants must not disclose or teach proprietary course information (e.g., structure, syllabus, techniques, event templates). This obligation is indefinite.

18. Compliance with Local Laws for Sound Bath Events

Participants are solely responsible for ensuring that any sound bath events they conduct, including practice events required for certification, comply with all applicable local, state, federal, or international laws, including but not limited to permits, noise ordinances, and health and safety regulations. Beyond Percussion is not liable for any violations, fines, or damages resulting from non-compliance.

19. Indemnification

Participants agree to indemnify, defend, and hold harmless Beyond Percussion, its affiliates, and instructors from any claims, damages, losses, or expenses (including legal fees) arising from their violation of these Terms and Conditions, misuse of course materials, non-compliance with local laws, or actions that harm Beyond Percussion’s reputation or intellectual property.

20. Data Privacy and International Participants

Data Protection: Participants consent to the collection, storage, and processing of personal data per U.S. data protection laws and Beyond Percussion’s Privacy Policy. Data may be stored in the U.S. or other countries with differing data protection standards.

Third-Party Services: Beyond Percussion uses third-party services for data storage and course content delivery and is not liable for issues arising from these services, to the extent permitted by law.

Taxes and Duties: Participants are responsible for taxes, duties, or customs fees in their jurisdiction.

Language: The course is provided in English. Participants must have sufficient proficiency to comply with requirements.

Jurisdictional Compliance: International participants must comply with local laws. Beyond Percussion is not responsible for ensuring compliance.

21. Anti-Harassment Policy

Beyond Percussion prohibits harassment, discrimination, or abusive behavior based on race, gender, religion, disability, or any protected characteristic in course interactions. Violations may result in expulsion without refund and potential legal action.

22. Accessibility

Beyond Percussion strives to make the course accessible per applicable standards. Participants requiring accommodations must contact questions@soundbathplayer.com at least 14 days before starting the course. Beyond Percussion will make reasonable efforts, but does not guarantee specific accommodations.

23. Governing Law and Jurisdiction

This Agreement is governed by the laws of California, excluding conflict of law principles. Disputes shall be resolved exclusively in state or federal courts in San Bernardino County, California. Participants consent to this jurisdiction and venue.

24. Attorney Fees

In the event that any dispute between the parties should result in litigation or arbitration, the prevailing party in such dispute shall be entitled to recover from the other party all reasonable fees, costs and expenses of enforcing any right of the prevailing party, including without limitation, reasonable attorneys’ fees and expenses. In addition to the foregoing award of attorneys’ fees, the prevailing party shall be entitled to its attorneys’ fees incurred in any post judgment proceedings to enforce any such judgment.

25. Force Majeure

Beyond Percussion is not liable for any delay or failure to perform its obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, technical failures, or third-party service disruptions. In such cases, Beyond Percussion may suspend course access or extend the Course End Date at its sole discretion. No refunds, credits, or other compensation will be provided for such delays or suspensions, except for what is required by law.

26. Limitation of Liability

Beyond Percussion’s liability is limited to the amount paid for the course. No liability exists for indirect, incidental, consequential, or punitive damages, to the extent permitted by law.

27. Severability and Entire Agreement

If any provision is invalid, the remaining provisions remain in effect. This Agreement, together with the GSP Course Confidentiality and Non-Disclosure Agreement, and the Certified Soundbath Player License Agreement, constitutes the entire agreement between Beyond Percussion and the participant regarding the Course, superseding all prior agreements on that subject. Consistent with the Related Agreements section above, no provision in this Agreement supersedes or invalidates those other agreements.

This Agreement also does not replace, limit, or invalidate any other confidentiality, non-disclosure, or participation agreement the participant has signed, or later signs, with Beyond Percussion, whether in connection with this Course, a Beyond Percussion workshop, or any other Beyond Percussion program, including without limitation any Unilateral NDA signed in connection with a SoundbathPlayer workshop. If the participant is bound by more than one such agreement, all such agreements remain in full effect, and wherever they conflict, whichever provision is more protective of Beyond Percussion’s Confidential Information controls.

28. Modification of Terms

Beyond Percussion may modify these terms at any time. Participants will be notified of material changes via email or the course platform. Continued participation constitutes acceptance.

29. No Warranty for Course Outcomes

The course is provided “as is” without warranties. Beyond Percussion does not guarantee professional success, skill mastery, or certification, which depend on participant effort.

30. Termination of Access

Beyond Percussion may terminate or suspend access for non-payment, inactivity, or violation of these terms. Termination does not entitle participants to a refund unless specified.

31. Acknowledgment

By checking the box on the registration form, you confirm you have read, understood, and agree to be bound by these Terms and Conditions. You acknowledge that the course is self-paced, certification requires meeting all requirements outlined in Section 12, and no specific outcomes are guaranteed. You further acknowledge the opportunity to consult legal counsel. Compliance is mandatory, and violations may result in expulsion without refund, certification revocation, and legal action.
